This paper focuses on two enduring features of Gareth Evans’s work. The first is his rethinking of standard ways of understanding the Fregean notion of sense and the second his sustained attempt to undercut the standard opposition between Russellian and Fregean approaches to understanding thought and language.I explore the peculiar difficulties that ‘I’ poses for a Fregean theory and show how Evans’s account of the sense of the first person pronoun can be modified to meet those difficulties.

The framework for the papers in this volume is set by the wide-ranging philosophical contributions of Gareth Evans, who died in 1980 at the age of 34. In the papers gathered together in the posthumously published Collected Papers and in The Varieties of Reference Evans made a number of important contributions to the philosophy of language, the philosophy of thought, and philosophical logic. Evans was a far more systematic thinker than is usual in contemporary analytical philosophy and the first part (...) of this introduction gives an overview of his thinking, setting it in the context of four powerful and competing currents in anglo-American philosophy in the 1960s and 1970s. One of the most urgent debates of our time is about the exact role that new technologies can and should play in our societies and particularly in our public decision-making processes. This paper is a first attempt to introduce the idea of CrowdLaw, defined as online public participation leveraging new technologies to tap into diverse sources of information, judgments and expertise at each stage of the law and policymaking cycle to improve the quality as well as the legitimacy of the (...) resulting laws and policies. First, we explain why CrowdLaw differs from many previous forms of political participation. Second,we reproduce and explain the CrowdLaw Manifesto that the rising CrowdLaw community has elaborated to foster such approaches around the world. Lastly, we introduce some preliminary considerations on the notions of justice, legitimacy and quality of lawmaking and public decision-making, which are central to the idea of CrowdLaw. (shrink)

El contenido del libro lo integran trabajos presentados por algunos de los más importantes filósofos anglosajones del derecho penal, todos ellos profesores en aquel momento en el Reino Unido. Dichos trabajos fueron discutidos por penalistas, filósofos y criminólogos de habla hispana provenientes de España, Argentina y Chile. En este sentido, el workshop ejemplificó también el tipo de acercamiento que los distintos mundos académicos, en este caso el mundo anglosajón y el hispano, o de forma más general el mundo jurídico del (...) common law y el de la tradición europea continental, están viviendo en estos días. The use of artificial intelligence in healthcare contexts is highly controversial for the (bio)ethical conundrums it creates. One of the main problems arising from its implementation is the lack of transparency of machine learning algorithms, which is thought to impede the patient’s autonomous choice regarding their medical decisions. If the patient is unable to clearly understand why and how an AI algorithm reached certain medical decision, their autonomy is being hovered. However, there are alternatives to prevent the negative impact of (...) AI opacity in shared (healthcare professional–patient) decision-making processes, and benefit from the high accuracy of such systems. Despite these ethical issues, this paper advocates for its usage and also defends the positive role that it could have in enhancing patients’ autonomy. I advocate for a system where the implementation of AI is only partial, and humans will remain in control of oversighting algorithm interpretation of medical images and patients’ data. (shrink)

When considering our own death, we normally weigh its impact on the people we love and care about, as well as worrying about the way in which our life might end, hoping that not too much suffering precedes it. However, such view, despite necessary, is a passive understanding of death, interpreted as something that merely happens to us, where we would have some control over timing if physician-assisted dying were legal in our countries. But what if our relation to death (...) would not end there? What if special medical needs, such as the emergency situation resulting from the Covid-19 pandemic, could have a direct impact on us creating a moral duty to end our lives? That is the thesis that will be advocated for in this paper: a moral duty to die will arise in some people to save resources that will help others get through Covid-19. It is important to indicate that the duty to die is personally acknowledged and self-imposed, thus nobody can be coerced to carry it out; for autonomy would be lost and such action should be considered an instance of incitement to die, therefore being morally blameworthy. What does an understanding of the first person pronoun “I” contribute to the understanding of a sentence involving “I”? This paper emphasizes that the first person pronoun is typically used as a tool of communication. We need to think not just about what it is to use the first person pronoun with understanding, but also what it is to understand someone else’s use of the first person pronoun. A plausible principle governing linguistic understanding via the conditions of adequacy upon reporting (...) speech entails what I call the symmetry constraint, which is that an account of the sense of “I” must leave open the possibility of sentences involving “I” saying the same thing as sentences involving “you”. One immediate consequence of the symmetry constraint is that we need to make a distinction between token-sense and type-sense, discussed in sections 1 and 2. A number of authors, most prominently Gareth Evans in his influential book The Varieties of Reference, have proposed that the sense of “I” needs to be elucidated, at least in part, in terms of the speaker’s sensitivity to forms of self-specifying information that have the property of being immune to error through misidentification relative to the first person pronoun. As emerges in section 3, however, this way of thinking about the sense of “I” is not compatible with the symmetry constraint, since it makes the sense of “I” private and unshareable. This leads in section 4 to an alternative proposal for doing justice to the insight that the sense of “I” reflects a distinctive way of being presented to oneself. On this proposal, the distinctive way in which I am presented to myself can be systematically related to the distinctive way in which I am presented to you. What matters is not that I am in receipt of distinctive types of information about myself, but rather that I have a distinctive ability to locate myself in objective space. On a plausible way of thinking about the individuation of cognitive abilities, this is an ability that you also can have and that underwrites both your understanding of “you” when you address me, and your understanding of “I” as uttered by me. This article analyzes Toole’s novel from a causal perspective, focusing on the cause-effect dynamics that make the plot advance, from the initial event at D.H. Holmes until the outcome in the Night of Joy. A combination of qualitative and quantitative methodologies has been applied to identify a series of 47 causal events that summarize all actions with an impact on plot development. Our research shows that the causal study of the novel is a useful approach that can reinforce or modify (...) qualitative assessments of previous studies. The relevance of “Night of Joy” plot within the whole narrative and its key role in the rest of the subplots are verified in numerical terms. Besides, we have expanded and quantified the causal chains operating in the novel; and we have made sure, as well, that every subplot is essential in order to reach the final outcome (with the only exception of Dr. Talc’s story). Finally, we have formulated an alternative outline of secondary plots than the ones supported by preceding research by using numeric metrics, demonstrating that “Paradise Vendors” and “Dorian Greene”, previously considered secondary storylines, exert a high impact on Confederacy’s finale, and are, perhaps, not so secondary plots after all. Sin embargo, nuestra hipótesis es que, si bien existe un cierto diálogo transtextual con los trabajos de ambos autores, es en la obra del historiador griego Polibio, Historias, donde se halla la principal relación de tipo hipertextual. Comparando la anaciclosis descrita por Polibio con la evolución política que Asimov narra (...) en sus novelas, comprobamos que las semejanzas no solo alcanzan a los diferentes sistemas de gobierno, sino incluso a la misma secuencia en que estos se suceden. El resultado es una obra que permite una interesante lectura palimpséstica, enriqueciendo sensiblemente la experiencia del lector con formación humanística.: Several scholars have analyzed the influence of Toynbee and Spengler, in the well-known saga of the Foundation, written by Isaac Asimov and considered one of the most important of science fiction. However, although there exists a transtextual dialogue with Spengler's and Toynbee’s works, our hypothesis is that the main hypertextual relationship must be searched in the work of the Greek historian Polybius, Histories. Comparing the anacyclosis described by Polybius with the political evolution that Asimov narrates in his novels, we can see that similarities not only reach different systems of government, but even the very same sequence in which they happen. The result is a work that allows an interesting palimpsestic reading, significantly enriching the experience of those readers possessing humanistic knowledge. (shrink)

En este artículo defendemos el valor de la perspectiva de Ortega sobre el problema del anacronismo en historia. Para ello, exponemos dicho problema en la Escuela de París. Seguidamente, explicamos las aportaciones de Ortega sobre ese problema en los años 40. Finalmente, hacemos un balance de las aportaciones de Ortega y su actualidad.
